Terms and Conditions of thefolklore.app

These terms govern use of Folklore (thefolklore.app, Folklore Manage and related apps) and the contract with the operator. Read them carefully.

If the Service was provided through the Apple App Store, Apple may enforce these terms as an intended third-party beneficiary.

What Folklore is

Folklore is a platform for discovering folk and related festivals, their programmes and venues. Folklore Manage is for organisers to administer festivals, content and, where offered, ticket sales.

Folklore is not a marketplace for physical goods, does not provide shipping or click-and-collect, and does not run a consumer virtual currency or an invite-friends programme.

Age

Anyone may browse the public map and published programmes. Creating an account, using Folklore Manage and buying tickets is for people with legal capacity to do so (typically 18). Parents or guardians are responsible for children.

Accounts

The public website does not have login yet. You can delete a Folklore app account in the app. For a Folklore Manage account, email support@thefolklore.app; we will close it unless a legal duty prevents it (for example accounting records). You are responsible for your login details. Use the account lawfully and in line with these terms. Gymber may suspend or close an account for serious breach, fraud or a security risk.

Content

Organisers are responsible for the accuracy and lawfulness of content they publish (programme, descriptions, photos, links). You grant us a non-exclusive licence to host, display and distribute that content within the Service for as long as it remains on the Service. Moral rights are not waived. We may remove content that breaks the law or these terms.

Public festival information is compiled from organiser materials and public sources. We aim to keep it current, but programmes, prices and ticket availability can change.

Tickets

If an organiser sells tickets through Folklore, the ticket contract is with the organiser, not Gymber, unless we say otherwise at checkout. Gymber provides payment infrastructure through Stripe Connect and may charge a platform fee. Card data is processed by Stripe.

Refunds, changes or festival cancellations follow the organiser’s terms and mandatory law. For leisure services on a specific date (a ticket to a dated event) the fourteen-day right of withdrawal generally does not apply under section 1837(j) of the Czech Civil Code.

Raise ticket complaints with the organiser first. Gymber may help as an intermediary but is not a party to the ticket contract unless stated otherwise.

Right of withdrawal

If you are an EU consumer and you conclude a distance contract with Gymber (for example a paid Folklore Manage plan), you generally have 14 days to withdraw without giving a reason. The period runs from the day the contract is concluded. Send a clear statement to support@thefolklore.app or to our registered office before the period ends. We will refund payments by the same method, without undue delay and at the latest within 14 days.

If you ask us to start providing the service before the period ends and then withdraw, you pay a proportionate amount for what has already been provided.

Folklore does not sell physical goods, does not offer click-and-collect and does not run a consumer virtual currency. For a ticket to a dated event (leisure services with a specific date), the fourteen-day withdrawal right generally does not apply under section 1837(j) of the Czech Civil Code; the ticket contract is with the organiser.

Paid organiser services

If an organiser takes a paid Folklore Manage plan, the price, term and how to end it will be shown in the order or on the site before the contract. We do not run a hidden auto-renewing consumer subscription that was not described in advance.

Acceptable use

You must not disrupt the Service, scan it beyond ordinary use, upload malware, impersonate others, infringe third-party rights or use the Service for unlawful content. Automated collection is allowed only to the extent we expressly permit (for example a public interface).

Liability

We are liable as required by law for damage caused intentionally or by gross negligence and for personal injury. Otherwise, where consumer law does not prevent it, Gymber’s liability is limited to foreseeable loss and, for organisers (businesses), to the fees paid to Gymber in the previous 12 months. We are not liable for an organiser’s decisions, for third-party network outages, or for content we did not create.

Consumers

If you are a consumer, rights that cannot be contracted out remain, including under the Czech Civil Code and the Consumer Protection Act. Out-of-court consumer disputes in the Czech Republic may be taken to the Czech Trade Inspection Authority (coi.cz). EU online dispute resolution: ec.europa.eu/consumers/odr.

Governing law

These terms are governed by Czech law. Consumers keep the mandatory protections of their country of habitual residence. Jurisdiction: for business users, the courts at Gymber’s registered office; for consumers, as provided by the applicable jurisdiction rules.

Changes

We may change these terms if the Service or the law changes. The new version will be published on this page. Continued use after the change takes effect is acceptance, unless mandatory law says otherwise. For material account changes we will email you if we have a contact address.

Illegal content

If you think content on Folklore is illegal, report it using the form at thefolklore.app/en/report. The report is emailed to the same inbox as the organiser contact form. Gymber s.r.o. is the contact point for authorities and for users under the EU Digital Services Act for this service.

How festivals are shown (organisers)

On the public map, festivals appear by geography. In lists they are grouped as popular (editorially pinned upcoming festivals), upcoming (by start date) and past (most recent first). Search matches names and descriptions. Map proximity after you allow location is for display, not a paid rank. We do not sell a higher position on the public map or in search.
